Police have released new surveillance video showing a man they say is one of two suspects in the fatal shooting of Gov. Cuomo administration lawyer Carey Gabay during the predawn J'Ouvert festivities in Prospect Lefferts Gardens on September 7th. Gabay was deputy counsel to the Empire State Development Corporation and was hit in the head amid crossfire on Bedford Avenue around 3:40 a.m. that morning. He was in a coma until his family elected to take him off of life support nine days later.
No arrests have yet been made. The NYPD has already released a sketch of the other suspect, and a video showing the two suspected gunmen running into a building. Police have suggested that the gun battle that claimed Gabay's life was between Folk Nation and Crips gang members who, usually allied, have broken into a bitter feud over control of the nearby Ebbets Field Apartments and other complexes.

At Gabay's funeral the weekend before last, Gov. Cuomo called for Democrats to threaten a government shutdown to pass stringent federal gun-control legislation. He backed off of that call this morning on WNYC's Brian Lehrer Show, lying by saying, "I didn't call for a government shutdown." He explained that what he meant by his original remarks—"our people should have the same resolve and threaten to shut down the government if they don't get a real gun control law"—was that Democrats should "put a real gun control bill on the table."
He continued: "I would make this presidential [race] about gun control; I would make congressional races about gun control; I would lean in toward it, Brian."
Gabay worked as a lawyer for Cuomo before moving to Empire State Development. Among the projects he worked on was helping to draft the SAFE Act, which bans high-capacity magazines, mandates background checks for gun purchases, and heightens penalties for crimes committed with banned guns.
