The parents of a 6-year-old autistic boy enrolled at PS 168 in Mott Haven are suing the school for not keeping track of an 11-year-old boy who was caught abusing and sodomizing their son in the school bathroom. On November 2nd another student caught the two in the school bathroom "and the victim cried out," according to lawyer Richard Sules. He told the Post, "My client’s non-verbal and autistic. His mother was telling me he was getting on the bus every day with this kid. He cried every day when he got on the bus, but she didn’t know why."
In a suit filed in the Bronx Supreme Court today, the victim's mother claims the school failed to watch the 11-year-old attacker, who would reportedly follow her son into the bathroom on a routine basis. Sules says, "The other kid was supposed to have a one-on-one paraprofessional [monitor] with him at all times" because of a developmental issue. Last year, the school received an F for student performance, D for student progress and C for student environment from the city Department of Education [pdf]. According to the report, "Schools that get Ds and Fs, or 3 Cs in a row, may face consequences, including change in school leadership or school closure."
