No Charges Against Driver Who Fatally Struck Brooklyn Man Unloading Car In Front Of Family

A Brooklyn man was fatally run over in Borough Park while unloading his car outside his home on Saturday night. According to the NYPD, 50-year-old Jose Barrera was struck by the 21-year-old driver of a Nissan Sedan shortly before 10 p.m. on 39th Street, between Fort Hamilton Parkway and 10th Avenue.
Barrera was rushed to Maimonides Medical Center, where he was pronounced dead.
According to a preliminary investigation, the unnamed driver "lost control" of his vehicle. He was taken into custody at the scene, but an NYPD spokesperson said on Sunday that the driver had not been charged.
Multiple news outlets report that Barrera was unloading groceries from the car when he was killed in front of his wife and 6-year-old daughter, who had both just exited the vehicle. They were unharmed.
Sources tell ABC 7 that the driver was taken into custody for suspicion of DWI. CBS 2 reports that the driver passed a DWI test and released.
According to the city's Vision Zero website, Barrera is at least the 29th pedestrian to be killed by a driver so far this year. The most recent data available from the NYPD indicates a 40 percent decrease in pedestrian injuries caused by drivers compared to 2019, possibly due to a decrease in motor vehicle traffic during the height of the coronavirus pandemic in NYC.
