Two randy real estate agents are under investigation in New Jersey after a scandalous lawsuit accused them of fornicating all over a client's home. Coldwell Banker realtor Robert Lindsay and his paramour, Jeannemarie Phelan, allegedly had sex again and again in various rooms of a house Lindsay was brokering in Wayne, NJ. (The real estate market is so hot there now.) Their alleged transgressions were discovered when the homeowners, Richard and Sandra Weiner, spotted them on a security camera banging, to use the parlance of our time.
The lawsuit also alleges that Lindsay "intentionally listed the house at above market value so that there would be little traffic in the home." Lindsay also allegedly made a second key to the home so that he could bring Phelan there without the visits being recorded by the key lockbox system realtors were expected to use when showing the house.
"All visits were for sexual encounters," the Weiners allege. "The last visit to the house by Lindsay and Phelan was on Jan. 23, 2012. Sandra Weiner happened to be checking the video cameras feed at the time and saw strange people in the house with what she thought were flashlights. The house was dark at the time. The Weiners called the local police, who then went to the house.
"The police opened the door to the house and found Lindsay pulling up his pants... Lindsay lied to police by telling them that he was there to prepare the house for an open house. … Instead, Lindsay and Phelan were at the house to have sex."
The Weiners say word of their sexy house spread among other real estate agents, and the sale of their home was tainted by the gossip, ultimately fetching far less than what Lindsay had predicted. Coldwell Banker says they stopped working with Lindsay after becoming aware of the allegations, and Phelan was reportedly fired from her job at Weichert Realtors in Pequannock on Monday.
A spokesman for the state Department of Banking and Insurance tells NJ.com that the New Jersey Real Estate Commission will investigate the alleged impropriety, and that Lindsay and Phelan could lose their licenses. "That is so out of line,” says Lois Kadosh, a real estate malpractice expert. “This is so far out there. They just didn’t want to pay for a room, I guess."
