Officer Daniel Pantaleo, the NYPD officer who put Eric Garner in a chokehold that led to his death in 2014, may face disciplinary action after the Civilian Complaint Review Board reportedly determined he should face department charges for the use of the chokehold.

Rolling Stone reports that the CCRB recommended their strongest rebuke, departmental charges, against Pantaleo after the board determined that he used a chokehold and restricted Garner's breathing. The magazine points out that this isn't a guarantee that Pantaleo will be disciplined by the NYPD, but that the substantiated charges are an admission by city investigators "that Pantaleo used a banned procedure and improper force." Last month, NYPD Commissioner James O'Neill reversed a verdict for an officer found guilty of misconduct by an administrative judge.

Pantaleo, who's been on desk duty since the July 2014 death, previously escaped charges from a grand jury (impaneled by current Staten Island congressmember Dan Donovan), and remains under investigation by the Department of Justice. His disciplinary records, which were leaked to the press earlier this summer by a member of the CCRB, showed that four out of 14 misconduct allegations against Pantaleo were substantiated.

When allegations are substantiated by the CCRB, it means that the board comes to the conclusion that a police officer committed the act they were accused of and that the action wasn't justified. In Pantaleo's case, the CCRB substantiated the charges that "PO Daniel Pantaleo used a chokehold against Eric Garner" and "PO Daniel Pantaleo restricted Eric Garner's breathing," according to Rolling Stone.

Reached by phone, representative from the CCRB declined to comment.
