[UPDATE BELOW] A cyclist was killed after being struck by a truck driver in Maspeth, Queens this morning.
According to an FDNY spokesperson, the truck's driver was making a right turn onto 48th Street from 56th Road around 8:46 a.m. when the driver struck the 34-year-old female cyclist. An NYPD spokesperson said the victim was biking west on 56th Road when she was struck.
The woman, whose name has not been released, was taken to Elmhurst Hospital in serious condition and later died, ABC7 reports. According to the news channel, the driver was towing a dump truck.
The driver remained at the scene and was interviewed by police. No charges have been filed and no arrests have been made.
Last summer the city's "Right of Way Law" went into effect, making failure to yield to a pedestrian an offense punishable by as much as $250 and 30 days in prison when there is an injury. As of May, there had been 23 total Right of Way arrests, including six city bus drivers, whose union subsequently fought to be exempt from the law.
Update, 5:42 p.m.: According to the NYPD, the 57-year-old driver hit the cyclist while turning right onto 48th Street from 56th Road. He was arrested at the scene, and charges against him are pending.
