A 74-year-old Connecticut man is suing the city for not forcing him to wear a helmet while riding a Citi Bike, which would have certainly protected him against a fall he took last year that he says robbed him of his sense of taste and smell.
Ronald Corwin is suing the city for $60 million for injuries he sustained after slamming his Citi Bike into a concrete barrier on East 56th Street near Madison Avenue in 2013. Last February, he filed a $15 million lawsuit alleging that the crash left him bereft of "the pleasure of tasting food and of literally smelling the roses," his lawyer said at the time. Since that apparently didn't pan out, Corwin has upped the ante, on Tuesday filing a lawsuit four times the size of the original. Makes sense. From the Post:
Corwin, who filed court papers on New Year’s Eve, charges that the city was reckless and negligent to be operating a bike- share program without helmets that could be rented out.
His lawyer, Michael O’ Donnell, said the city can’t blame Corwin for not wearing one after saying it’s less dangerous than driving or crossing a street.
In the unlikely event that Corwin doesn't win this one, it's clear that the least the city can do is bankroll a complement of armed body guards to protect him whenever he visits NYC, or at least assign him a dedicated officer to enforce his helmet-wearing. Seeing as the cops have so much time on their hands and all.
