Threatened Upper East Side dive bar Subway Inn has been given a stay of execution that will allow it to temporarily stay in its home on East 60th Street. A Manhattan Civil Court judge has issued a temporary restraining order that blocks the bar's eviction, which would have happened today.
The order gives the Salinas family—who have owned the bar for more than 40 of its 77 year history—seven business days to get their materials ready to support their challenge to the eviction. "Yesterday's decision...comes because of the hard work and determination of a group of New Yorkers and Lawmakers that aren’t afraid to stand up for what is right," the family declared on the bar's Facebook page. "We know that this is just the first step in a very long and hard David Vs. Goliath Fight; however, we are confident that in the end justice prevails and the Subway Inn will be spared from the wrecking ball."
The family began an aggressive campaign to fight their landlord, World-Wide Holdings Corp, including petitions and crowdsourcing campaigns to pay for legal fees.
Last week, World-wide Holdings issued a statement saying the Salinas family has repeatedly signed one-year leases with a 30-day termination option, “each time recognizing that the site would eventually be used for development. Subway Inn has been part of the landscape of the community for many years. However, the bar’s closing should not come as a surprise. From the time that the World-wide Group purchased the site in 2006 from William Ackerman and agreed to allow the Salinas family to operate the bar, it was acknowledged that a development was going to take place at the site.”
The family has until 9:30 a.m. on August 27th to present their case against eviction.
