A handful of Midtown restaurant chains—Olive Garden, Red Lobster, Ruby Tuesday and Applebee's among them—are facing a lawsuit for illegally adding automatic gratuity to the checks of small groups of diners, the Post reports.

What's most surprising here, however, is that the charges come not from some penny-pinching tourist just appalled by soaring city (Midtown) prices, but Ted Dimond, tennis instructor to New York's power elite and a lifelong New Yorker. What were you doing at Applebee's, Ted!? ARE YOU OK?

Dimond's attorney assures us that his client—who gives tennis lessons to the likes of Naomi Watts and Liev Schreiber—"also dines at more upscale restaurants where illegal tipping happens," but that those listed happen to be the most egregious offenders.

Dimond apparently will not rest until "wronged customers" are recouped $50, plus "$1,000 for 'willful violations,'" in cases where the deceit is intentional. Your move, Marilyn Hagerty.
