A special Senate panel has recommended that NY Senator Hiram Monserrate be expelled or censured after being convicted of a misdemeanor assault in October. Monserrate, who was acquitted of a felony but found guilty of causing physical injury to his companion, Karla Giraldo, by dragging her though his lobby with a cut face, has said that he'll not leave his post. But with the panel's suggestions moving on to the Senate, will he have a choice?

According to the AP report, a lawyer for the Queens Democrat, Joseph Tacopina, has said there are no legal grounds for expulsion. The senator will vote as usual on Tuesday and if asked to step down he'll consult with his attorney, CBS reports. Earlier this month, Monserrate was sentenced to probation, though his crime could have gotten him up to a year in jail. The former NY police officer and Marine was sworn in just weeks after the incident with his girlfriend.

"There was no predetermined outcome here," said Sen. Andrew Lanza, a member of the committee that recommended Montserrate's expulsion of censure. "The process has been very open and continues."
